VA is being sued by vets over benefits discrimination issue

When members of the military are injured while serving this nation, the affected personnel, their loved ones and the general public generally expect that the Department of Veterans Affairs (VA) will ensure that these heroes are properly taken care of. However, a recent scandal has revealed that some military personnel are being given more access to the services that they are entitled to than others are.

Recently, a number of veterans groups filed a claim in federal court alleging that certain veterans are being denied proper access to veterans disability benefits and other entitlements after being injured while serving in the military. Specifically, individuals who have suffered sexual assault while serving are being denied appropriate benefits.

The Vietnam Veterans of America and the Service Women’s Action Network filed the claim jointly. The claim asserts that the VA has failed to act on a petition insisting that military sexual trauma victims are being held to an unreasonably high standard of proof when they apply for benefits in order to treat their post-traumatic stress disorder.

The executive director of the Service Women’s Action Network recently explained that, “Post-traumatic stress is post-traumatic stress, it shouldn't matter the cause. The policy leaves too many loopholes for claims officers to deny (sexual assault) survivors their benefits."

If you or a loved one has suffered sexual assault or other trauma while engaged in military service, please do not hesitate to contact an experienced attorney about obtaining veterans disability benefits. The benefits system may be flawed at the moment, but hopefully this latest suit will help to change that reality for the better.
