Workers' compensation and SSD benefits

Workers across the United States, including in Tennessee, have probably been told that they have workers' compensation coverage so they are entitled to receive benefits in the event of an injury or disability that occurred in the workplace. In addition, in the case of a fatality, the accident victim's family may be entitled to receive compensation on behalf of their loved one. The benefits usually cover expenses related to medical care, dependency benefits, rehabilitation, funeral and both temporary and permanent disability treatment. Loss of income due to injury or illness in the workplace is also covered under this program.

It may be difficult to calculate the exact amount for such benefits, considering that there is no exact formula that exists. However, the type of disability and the potential loss of income that a person suffers are taken into account. Not all occupational diseases and injuries are covered under workers' compensation. Some injuries and diseases may be exempt from the list of occupational, or work-related, injuries.

For temporary disabilities, total temporary disability benefits are awarded to the workers only after physicians verify the disability. Typically, just more than 66 percent of the worker's gross wage is paid. The compensation amount is determined so that the workers and their families do not experience financial hardship. If a worker returns to work with limited working capacity, there may still be a loss of wages and the worker will continue to receive disability benefits in that case.

Permanent total disability benefits and Social Security Disability benefits are similar in nature because they both compensate for serious injuries, diseases and disabilities suffered in the workplace.
