Are SSDI benefits available if I was injured on the job?

To be injured at your workplace can be a scary occurrence for a Tennessee resident. Used to earning a regular paycheck, an injured Tennessean may be frightened and unsure how he or she will provide for his or her family. Fortunately, in addition to possible workers' compensation benefits, Social Security Disability Insurance (SSDI) benefits may be available for those persons who have suffered a work-related injury.

In addition to benefits that may be available through Tennessee's workers' compensation program, the Social Security Administration provides SSDI cash payments worth billions of dollars to injured workers annually. It is important for injured workers to understand how the workers' compensation benefits system relates to an award of SSDI benefits, as the relationship between the two programs may affect an injured worker and his or her benefits.

When a worker becomes injured, payments that he or she might receive from a private pension or other insurance will not affect the amount of a person's SSDI benefits, but workers' compensation benefits have the possibility of reducing a worker's benefit amount. The SSA will consider the amount of benefits a worker receives through the workers' compensation system in its determination of a person's SSDI benefits. The total amount of workers' compensation benefits and Social Security Disability benefits may not exceed 80 percent of a person's average earnings before he or she became disabled. How the SSA determines a person's average earnings will depend on circumstances particular to a worker.

An injured worker must notify the SSA of any change to his or her workers' compensation benefits, or other public disability benefits, as such a change may affect a worker's SSDI benefits. If you have been injured on the job and are dealing with the possibility of long-term care needs and an inability to work, you may find that an attorney's guidance regarding available benefits can be helpful.
