Can victims of traumatic brain injuries receive SSDI benefits?

When a Tennessean suffers an injury, the best case scenario is that he or she will recover fully and quickly, and with as little medical intervention as possible. Unfortunately, however, that is not always the case, and some Tennesseans suffer injuries that leave them permanently disabled. One particularly damaging form of injury that can forever alter a person's life is a traumatic brain injury.

Fortunately, the Social Security Administration may provide SSDI benefits for those people who have suffered a disabling brain injury. Traumatic brain injuries may happen from a variety of causes and can lead to a range of symptoms following the injury.

Often, it can be difficult to predict how a person with a brain injury will recover. A victim may never fully recover, or may recover slowly over time. Frighteningly, a person may appear to be recovering mentally, but then suffer a turn for the worse and have his or her condition go downhill. It may take up to six months to evaluate how severe a person's mental impairment is following a traumatic brain injury.

For some injury victims, however, their neurological impairment may be so severe that the SSA can make a determination of disability within the three months immediately following the injury. For those whose injuries do not qualify for a quick determination, the SSA will wait until at least three months following an injury to make a determination of disability, and may wait until six months have passed since a brain injury to determine a person's level of disability.

People in the Hamilton County area who have suffered a traumatic brain injury may be able to receive qualifying SSD benefits for injury. An attorney can offer valuable guidance regarding the application process and timeline.
