What if I need a special exam to keep my SSD benefits?

Tennesseans who are seeking benefits through the Social Security disability program are often unaware of certain requirements that must be met. One is that there might be a need for a special examination for a final decision to be made. This applies for both Social Security disability or Supplemental Security Income. When there is a disability application, the Disability Determination Services will review it. But, if it is necessary to garner more information before making a decision, a special examination might be required.

With the special examination, the SSA will pay for it. If there are travel expenses, these will also be paid by the SSA. When there is a doctor who is not the regular doctor for the claimant performing the examination, results can be sent to the claimant's regular doctor for their review. The claimant must take the test and be cooperative. Simply missing the appointment without an excuse will result in the decision being made based on the information that the state agency already has. Considering the need to have the special examination, the chances of approval after missing the appointment are limited.

The individual conducting the special examination will only seek the information that the state agency requested. No treatment or medication will be prescribed. After the examination, the state agency will review the results as an addition to the other information that is available. Then, a decision as to whether or not to approve SSD benefits will be made. If the claimant does not agree with the decision, there is the right to file an appeal just as a conventional application without a special examination would be appealed.

For those who have questions or concerns about any aspect of the disability process, from applying, going through the special examination, and filing an appeal if necessary, having legal help is key. An attorney who has experience in all aspects of Social Security disability benefits can provide assistance.
