How do legal convictions or warrants affect my SSD benefits?

Tennessee residents who are receiving Social Security disability benefits might run into various circumstances that might affect these benefits. For example, there is certain information that must be provided to the Social Security Administration to make certain all the requirements based on federal regulations are followed. Issues with the law such as an arrest or conviction do not necessarily mean that the benefits will stop forever, but it is imperative to follow the rules set by the Social Security Administration (SSA) when it comes to informing them of the situation.

For example, a person who is seeking or receiving SSD benefits must tell the SSA if there is an outstanding warrant for his or her arrest for the following felonies: flight to avoid prosecution or confinement, an escape from custody and flight-escape. While there is this outstanding warrant, the person will not be able to receive disability or underpayments he or she might be owed in a month when there is the warrant in effect.

If a person is convicted of a crime, the SSA must be told as soon as possible. When a person is incarcerated for a crime, he or she cannot get SSD benefits during that period. However, family members who are eligible might be able to get benefits if they are based on the incarcerated person's work record. In general, monthly payments or underpayments that could be due are not to be paid to a person who has committed a crime and is in an institution via a court order and it is at the public expense. This is true in the following circumstances: if the person was not guilty by reason of insanity or had other mental issues; or if he or she is found incompetent to stand trial.

A person who violated parole or probation cannot get SSD benefits or underpayments for the month in which the violation was committed. Even those who are facing problems with the law or have such issues in their past can get disability benefits. However, there are rules that must be followed.
