Continuing eligibility and reviews for SSD benefits

Tennesseans who are approved for benefits from Social Security disability need to know that in most cases, the benefits are not going to continue forever. There are, of course, some situations where the SSD benefits can be relatively assured of being long-term. Most circumstances are not like that, so it is important to know about continuing eligibility for benefits and the protocol for a review of the disability.

In the bulk of cases, the benefits will continue while the claimant is considered disabled. If there are changes such as the health improving until the person is not considered disabled or the person would like to return to work, the eligibility can change. The law states that the disability is subject for review at certain intervals to make sure that the person remains disabled. The Social Security Administration will let the person know when there will be a review. The recipient must also let the SSA know if there is an improvement to the illness, condition or injury that warranted the benefits or if he or she returns to work.

The reviews and the frequency with which they occur depends on the disability and its prognosis. If there is expected improvement, the case will be reviewed between six and 18 months after they have started. With possible improvement, the benefits will continue for three years before a review might happen. If there is no expectation of improvement, the case will generally not be reviewed for seven years.

Everyone has a different situation when they are seeking and receive Social Security disability and should have a fundamental grasp of the way the SSA goes about determining if the SSD benefits should continue. Those who are seeking benefits or are receiving benefits should be aware of the basics of continuing eligibility and a review. Help from a legal professional with a firm understanding of Social Security disability benefits is available and can be beneficial with all parts of a claim.
